# Terms of Service — email-validate
> ⚠️ TEMPLATE DRAFT (Gate B1). Not legal advice. Placeholders in [BRACKETS]
> must be filled and the whole document reviewed before Gate C launch.
Effective date: [DATE]. Operator: [ERIC / ENTITY NAME, ADDRESS, CONTACT EMAIL].
## 1. The Service
email-validate ("the Service") checks email addresses for syntactic validity,
domain mail-exchange records, disposable-domain status, provider type, and
likely typos. Results are **heuristic signals, not guarantees**: a "valid"
verdict does not guarantee deliverability, and an "invalid" verdict may be
wrong. The Service is provided "as is".
## 2. Access, keys and rate limits
The Service is currently open — no account or API key is required. Free-tier
access is rate-limited per client IP address (a one-way hash of the IP is used
for enforcement; raw addresses are not stored — see the Privacy Policy).
Evolving the limit or circumventing it (e.g. rotating IPs or proxies to evade
the free cap) is a breach of these terms.
Optional API keys: requests may include an `x-api-key` header. Keys are
secret; you are responsible for all usage under your keys. Notify us
immediately if a key is compromised and we will rotate it. When paid tiers or
accounts are introduced, these terms will be updated before they take effect.
## 3. Acceptable use
You agree not to use the Service to: violate any law or third-party right
(including anti-spam laws such as CAN-SPAM/GDPR when acting on results);
resell raw validation output as a competing validation service; probe, load-
test, or attempt to circumvent rate limits or quotas; or submit addresses in
violation of a platform's terms. We may suspend keys that breach these rules.
## 4. Your data responsibilities
You are the controller of any personal data (email addresses) you submit; we
process them transiently as a processor to produce your result and do not
persist them. You are responsible for having a lawful basis for the addresses
you validate.
## 5. Availability
Best-effort operation. No uptime SLA is offered unless separately agreed in
writing. We may modify or discontinue features with reasonable notice.
## 6. Fees (paid tiers)
When paid tiers launch: plans are prepaid monthly in advance. Quota resets as
described in the pricing documentation; exceeding quota returns an error
rather than an overage charge. Prices may change with 30 days' notice.
Refunds within 7 days of first payment on request.
## 7. Termination
Either party may stop using / providing the Service at any time. On request we
delete account and usage data associated with your keys.
## 8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to
the fees you paid in the 12 months preceding the claim (or $100 for free-tier
use). We are not liable for indirect or consequential damages, including lost
email deliverability or business loss from incorrect validation results.
## 9. Changes
We may update these terms; material changes will be announced at least 14 days
in advance via the site or your signup email. Continued use constitutes
acceptance.
## 10. Governing law
[JURISDICTION — TO BE CONFIRMED WITH ACCOUNTANT AT GATE B2]. Disputes resolved
in the courts of that jurisdiction.
